Replacing The Judge

In California, you can remove a judge in any civil matter, including a divorce, by making a timely challenge. Usually, it is not a good idea.

In his case, Rocker Richie Sambora has moved to replace the judge presiding over his divorce case.

The Bon Jovi guitarist filed papers in Los Angeles on Friday - just weeks after Heather Locklear petitioned for a divorce - asking that the judge assigned to preside over his case be removed.

The papers read: "The judge is prejudiced against the party or the interest of the party so that the affiant (Sambora) cannot or believes that she (Sambora's attorney) cannot have a fair and impartial trial."

Engagement Rings and the Law

Other than Christmas, Valentine's Day is the day when most engagements take place. Traditionally, with the marriage proposal comes an engagement ring. In an ideal world, newly engaged happy couples stay that way through to the wedding. However, in the event things don't quite go as planned, it might be practical to know what legal rights surround the engagement ring in the event of a breakup.

An engagement ring that accompanies a proposal is considered to be a gift given in the contemplation of marriage. The gift in the form of the engagement ring would not be given unless for the promise of a future marriage. There is a statute in the California Civil Code 1590 that addresses this type of gift.

According to the statute, the circumstances surrounding the breakup determine the proper owner of the engagement ring. The "giver" may recover the ring or the value of the ring if the "receiver" refuses to enter into marriage. The "giver" also has a right to recover the ring if the contemplated marriage is abandoned by mutual consent.

Although not explicitly stated in the statute, subsequent case law has determined that the "receiver" of the engagement ring is entitled to keep the ring if the "giver" refuses to enter the marriage without any fault of the "receiver." Therefore, if the "giver" is the one who backs out of the wedding, then the "giver" does not have the right to get the engagement ring back.

Even though the statute specifically applies to gifts given in contemplation marriage, general principles of fraud may still apply and affect any claim to recovery.

Steelers Fans Argue Over Tickets In Divorce---"Wife: 'I'll Go To Jail For My Tickets"

Under the category of "I want to be as vindictive as I can" comes this story from wpxi in Pittsburgh. If you don't know by now, the Pittsburgh Steelers are in Sunday's Super Bowl.

Patty Green is a longtime Steelers season ticket holder who won Super Bowl tickets in the lottery.

Her ex-husband Steve had his attorney file a motion to throw her in jail if she didn't sell him the season tickets as part of paying him back.

Then, when he refused to let the couple's 16-year-old daughter go to the Super Bowl with her mom, she immediately gave the tickets away.

Patty Green said, "I gave them to someone else." Channel 11's Kimberly Easton asked, "Why'd you do that?" Green said, "Because I don't want him to have them. I don't know what he wants. I don't know if he wants to see me in jail, but I will go to jail for my tickets."

Late Monday afternoon, Steve released this statement, "Based on the judge's decision earlier today and on advice of counsel, I have determined that it is in the best interest of the parties to withdraw my request for the two Super Bowl tickets from Mrs. Greene. I will pursue other more conventional means to enforce the order."

January is the top month for divorces

According to the New York Post, January is the peak month for women to dump their husbands. Gloria Allred adds her insight: "In January, people are returning gifts and recycling husbands." She adds that "It's that the fault lines are showing underneath the surface and in January it explodes."

A New York divorce lawyer adds that the most common reason for divorce is that during the holiday season one spouse may discover their partner's hanky-panky.
